Welcome to FiFutures LLC (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the mobile application, website, software, content, financial tools, educational resources, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must:

  • Be at least 18 years old; if 14 - 17 years old, a parent or guardian will need to provide consent

  • Reside in a jurisdiction where the Services may legally be offered;

  • Have the authority to enter into these Terms; and

  • Provide accurate and complete registration information.

You may not use the Services if you are prohibited from doing so under applicable law.


2. Nature of the Services

The Services are designed to help users:

  • Track spending and budgeting;

  • Improve financial literacy;

  • Monitor financial habits and goals;

  • Aggregate financial account information through third-party providers;

  • Receive educational content, insights, reminders, and recommendations.

The Services are provided for informational and educational purposes only.


3. No Financial, Legal, or Tax Advice

The Company is not a bank, broker-dealer, investment adviser, accounting firm, tax adviser, or law firm.

Nothing within the Services constitutes:

  • Financial advice;

  • Investment advice;

  • Legal advice;

  • Tax advice;

  • Credit counseling; or

  • Fiduciary services.

Users should consult qualified professionals before making financial decisions.


4. Third-Party Financial Data Providers

The Services may integrate with third-party providers, including but not limited to:

  • Plaid

  • Other financial data aggregators, banks, or payment processors.

By linking financial accounts, you authorize the Company and its service providers to:

  • Access account and transaction data;

  • Retrieve balances, account ownership information, and transaction history;

  • Process and display such data within the Services.

Your use of third-party services may also be governed by separate agreements and privacy policies.

The Company is not responsible for:

  • The availability or accuracy of third-party services;

  • Financial institution outages;

  • Data delays or synchronization issues;

  • Errors originating from third-party providers.


5. User Accounts

You are responsible for:

  • Maintaining confidentiality of account credentials;

  • Restricting access to your device and account;

  • All activity occurring under your account.

You agree to notify us immediately of any unauthorized use or security breach.


6. User Content

You may provide information, comments, goals, notes, financial categories, and other content (“User Content”).

You retain ownership of your User Content, but grant the Company a worldwide, non-exclusive, royalty-free license to:

  • Host;

  • Store;

  • Process;

  • Analyze;

  • Display; and

  • Improve the Services using such content.


7. Data Analytics and Product Improvement

You acknowledge and agree that the Company may use:

  • Aggregated data;

  • De-identified data;

  • Anonymized usage patterns;

  • Behavioral analytics;

  • Statistical information;

for:

  • Product development;

  • Machine learning and AI improvements;

  • Benchmarking;

  • User experience optimization;

  • Research and analytics.

The Company will not knowingly sell personally identifiable financial information except as permitted by law or disclosed in the Privacy Policy.


8. Subscription and Payment Terms

If applicable:

  • Certain features may require a paid subscription;

  • Subscription pricing will be disclosed before purchase;

  • Fees are non-refundable except where required by law.

Subscriptions may automatically renew unless canceled before renewal.

App store billing terms may also apply.


9. Prohibited Conduct

You agree not to:

  • Violate any law or regulation;

  • Reverse engineer the Services;

  • Use automated scraping tools;

  • Attempt unauthorized access;

  • Upload malicious code;

  • Impersonate others;

  • Engage in fraud or money laundering;

  • Use the Services for unlawful financial activity.

10. Intellectual Property

All rights, title, and interest in the Services, including:

  • Software;

  • Branding;

  • Logos;

  • Educational materials;

  • Algorithms;

  • Design elements;

remain the exclusive property of the Company and its licensors.

No ownership rights are transferred to users.


11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING:

  • MERCHANTABILITY;

  • FITNESS FOR A PARTICULAR PURPOSE;

  • NON-INFRINGEMENT;

  • ACCURACY OF FINANCIAL DATA;

  • UNINTERRUPTED ACCESS.

We do not guarantee that:

  • Budgeting recommendations will improve financial outcomes;

  • Financial data will always be accurate or current;

  • The Services will be error-free.


12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR:

  • INDIRECT DAMAGES;

  • LOST PROFITS;

  • FINANCIAL LOSSES;

  • LOST DATA;

  • CONSEQUENTIAL DAMAGES;

  • DECISIONS MADE USING THE SERVICES.

THE COMPANY’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY THE USER TO THE COMPANY IN THE PRECEDING TWELVE (12) MONTHS.


13. Indemnification

You agree to indemnify and hold harmless the Company and its affiliates from claims arising out of:

  • Your misuse of the Services;

  • Your violation of these Terms;

  • Your violation of applicable law;

  • Your infringement of third-party rights.


14. Termination

We may suspend or terminate access to the Services at any time for:

  • Violations of these Terms;

  • Fraudulent or suspicious activity;

  • Security concerns;

  • Legal compliance obligations.

Users may stop using the Services at any time.


15. Arbitration and Dispute Resolution

Any dispute arising under these Terms shall be resolved through:

  1. Informal good-faith negotiations;

  2. Binding arbitration; and

  3. Individual claims only (no class actions), where permitted by law.
